Terms of service

1. General

1.1 These terms and conditions apply to all offers, orders, and agreements between Hasenbos Militaria and Curiosa VOF and its customers.
1.2 Every order implies that the customer has read and accepted these terms and conditions.
1.3 The price of the items offered is calculated for delivery ex-warehouse, excluding shipping or transport costs.
1.4 We aim to dispatch orders within 3 business days after receipt of payment.
1.5 Items transported by third parties travel at the expense and risk of the buyer, unless otherwise agreed in writing.
1.6 Exceeding delivery times does not entitle the customer to compensation or cancellation of the agreement.
1.7 Our items are intended solely for collectors and for display or educational purposes, not for actual use or wearing.

2. Payment

2.1 Payment can be made via bank transfer (ING: NL25 INGB0007136442, BIC: INGBNL2A, payable to Hasenbos Militaria and Curiosa VOF).
2.2 Payment is also possible via the payment methods listed on our website.
2.3 All payment-related costs and bank charges are the responsibility of the buyer.
2.4 Payment must be received within 7 days of placing the order. If payment is not received, we reserve the right to cancel the order.

3. Warranty & Returns

3.1 Unless expressly stated otherwise in the product description, all items we offer are original period pieces.
3.2 If you are not satisfied, you may cancel the purchase within 14 days of receiving the goods. You must notify us in advance by email.
3.3 Returns are only accepted in their original condition. You will receive a refund of the purchase price excluding shipping costs.
3.4 Return shipping costs are the responsibility of the buyer.
3.5 Legal right of withdrawal: due to the nature of the goods (antiques/collectibles), the statutory right of withdrawal may be limited in some cases. Nevertheless, we apply a 14-day goodwill return period, provided the item is returned in its original condition.
3.6 The right of withdrawal does not apply to:
– Items that are damaged, disassembled, or altered after receipt.

4. Descriptions & Photos

4.1 All photos form an integral part of the product description.
4.2 Customers must carefully review the description and photos before purchase; not every detail can always be stated in writing.

5. Shipping

5.1 Item prices do not include shipping costs.
5.2 Orders are generally shipped within 72 hours after receipt of payment (excluding weekends and public holidays).
5.3 We ship via PostNL.
5.4 Orders valued at €500 or more are shipped insured at our expense.
5.5 The risk of loss, theft, or damage during transport lies with the buyer. Only the carrier is liable in case of disputes.
5.6 The delivery address provided at checkout is binding; we are not responsible for incorrectly entered addresses.

5.7 The products are not insured. At checkout, you can choose to add insurance. This costs 1% of the total value, with a minimum flat fee of €10.

6. Prices

6.1 All prices include 21% VAT and exclude shipping costs.
6.2 All prices are stated in euros (€).
6.3 Obvious typographical or pricing errors are not binding and entitle us to cancel the agreement.

7. Taxes & Customs

7.1 For deliveries outside the EU, import duties, taxes, and customs fees may apply.
7.2 These costs are entirely the responsibility of the buyer.
7.3 We are not obliged to inform the buyer of potential import duties; this is the buyer’s responsibility.

8. Liability

8.1 We are not liable for loss, delay, or incorrect delivery caused by an incorrectly provided address by the buyer.
8.2 We are not liable for damage, loss, or theft of parcels during shipment.
8.3 We are not liable for indirect, consequential, or loss-of-profit damages.
8.4 The buyer is fully responsible for the use of the goods. Our items are not suitable for practical use (such as wearing or functional application), and we accept no liability for such use.

9. Privacy

9.1 We handle personal data with care and process it solely for the fulfillment of orders and payments.
9.2 We comply with the General Data Protection Regulation (GDPR).

10. Intellectual Property

10.1 All photos and texts on our website are the property of Hasenbos Militaria and Curiosa VOF and may not be copied, distributed, or reused without written permission.
10.2 It is not permitted to use our company name or images of our products for commercial purposes without prior consent.

11. Retention of Title

11.1 Delivered goods remain the property of Hasenbos Militaria and Curiosa VOF until full payment of the purchase price, including shipping and additional costs, has been received.

12. Force Majeure

12.1 We are not liable for delays or failure to fulfill our obligations due to circumstances beyond our control, including but not limited to: war, natural disasters, strikes, epidemics, fire, government measures, transport disruptions, or internet/communication failures.

13. Disputes & Applicable Law

13.1 All agreements and transactions are governed exclusively by Dutch law.
13.2 Any disputes will be submitted solely to the competent court in the district where Hasenbos Militaria and Curiosa VOF is established.
13.3 If you have a complaint, please contact us first so that we can work together to find a solution.

14. Disclaimer – Historical and Educational Purposes

14.1 Hasenbos Militaria and Curiosa VOF trades only in original historical objects of collectible, museum, or educational value.
14.2 We explicitly distance ourselves from far-right, hateful, racist, antisemitic, or discriminatory ideologies or organizations.
14.3 Our items must not be used to promote such views or purposes.
14.4 By making a purchase, the buyer declares that he/she will use the items solely for private collection, historical study, or museum/educational purposes.

15. Age Restriction

15.1 By placing an order, the buyer declares that he/she is at least 18 years old and legally capable of making the purchase.
15.2 If it is determined after purchase that the buyer is under 18, we reserve the right to cancel the order and charge any costs incurred.
